Sweepstakes Official Rules

NO PURCHASE NECESSARY. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. YOU MUST BE EIGHTEEN (18) YEARS OF AGE OR OLDER TO PARTICIPATE. THIS SWEEPSTAKES IS SUBJECT TO ALL APPLICABLE LAWS AND IS VOID WHERE PROHIBITED.

1. Sponsor and Administrator: Amplitude Research, Inc. ("Amplitude"), 2255 Glades Road, Suite 324A, Boca Raton, Florida 33431, is the Sponsor and Administrator of the Sweepstakes and is conducting this survey on behalf of its client, ELAP Services, LLC ("ELAP"), 1550 Liberty Ridge Drive, Wayne PA, 19087. The Sweepstakes are in no way sponsored, endorsed, or administered by Visa, Visa International Service Association, or its / their affiliates. Inquiries concerning the Sweepstakes should be directed to Sponsor. More information about Amplitude can be found at http://www.AmplitudeResearch.com. 2. Eligibility: The Sweepstakes is open only to legal residents of the fifty (50) United States and the District of Columbia who are at least 18 years of age at the time of entry (age 19 in Alabama and Nebraska, and age 21 in Missouri). Void in Puerto Rico. Employees of Amplitude or ELAP and their parents, affiliates, and subsidiaries, as well as their family and household members, are not eligible to participate in the Sweepstakes. Participation constitutes entrant's full and unconditional agreement to these Official Rules and acceptance of Sponsor's and Administrator's decisions, which are final and binding in all matters related to the Sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth herein. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law.

3. Timing: The Sweepstakes begins on May 15, 2017 at 8:00:00 a.m. Eastern Standard Time and ends on June 23, 2017 at 11:59:59 p.m. Eastern Standard Time (the "Entry Period"). Amplitude reserves the right to extend the Entry Period if the survey period is extended, in which case the Entry Period shall end on the last calendar day of the extension period at 11:59:59 p.m. Eastern Standard Time. (In the event of such extension, the new end date will be posted here). Administrator's computer is the official time-keeping device for the Sweepstakes.

4. Entry: NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT IMPROVE YOUR CHANCE OF WINNING. THIS SWEEPSTAKES IS SUBJECT TO ALL APPLICABLE LAWS AND IS VOID WHERE PROHIBITED. Only one (1) entry per person is permitted regardless of the manner of entry. Any attempt by any person to obtain more than one (1) entry by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that person's entries and that individual may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. There are two (2) ways to enter the Sweepstakes during the Entry Period:

A. Online Survey Method of Entry: To enter by completing the survey questionnaire, you must be invited by your company which has either directly or through their plan administrator contracted with ELAP for services and received an email inviting you to participate (the "Invitation") during the Entry Period branded as "Health Plan Satisfaction Survey" or similar heading. If you receive an email invitation that is not branded in this manner, or you are not an employee of an organization that has contracted either directly or through their plan administrator contracted with ELAP for services, then completion of the questionnaire will not enter you into the Sweepstakes. The person receiving the email invitation must submit the questionnaire during the Entry Period to be automatically entered into this Sweepstakes. The Invitation is non-transferable. Duplicate entries will be voided. Limit one prize per participant.

B. Alternative Means of Entry: To enter without having to complete the survey questionnaire, an individual can print his or her name, address, telephone number, email address, and date of birth (include day, month and year) on a 3" x 5" piece of paper or index card and mail it with correct postage to: Amplitude Research, Inc., 2255 Glades Road, Suite 324A, Boca Raton, Florida 33431. Please be sure to include the words (or similar words) "Health Plan Satisfaction Survey" in the request. All mail-in entries must be received by Sponsor during the Entry Period. No facsimiles, photocopied or mechanically reproduced entries allowed. Use of any automated system to submit entries is prohibited and will result in disqualification. Only one (1) entry per envelope; if an envelope contains multiple entries, then all entries contained within the envelope will be disqualified and void.

5. Selection of Winners: There will be one (1) entry pool for the Sweepstakes, consisting of the eligible entries via participation in the survey and mail-in entries. Survey participation is directed at employees whose company has either directly or through their plan administrator contracted with ELAP. All entries become the exclusive property of Sponsor and Administrator and will not be acknowledged or returned. Sponsor and Administrator are not responsible for lost, late, incomplete, invalid, unintelligible, or misdirected submissions, information, or entries, which submissions or entries will be disqualified and void. Administrator will randomly select ten (10) winners from all eligible entries. Administrator will notify the potential winner using the email address to which the survey invitation was sent (or, if there is a field at the end of the survey asking the respondent to enter his/her email address, that email address will be used instead) or submitted by the winner in his/her entry, as applicable, and request that the individual send a reply email to Administrator confirming the individual's participation in the Sweepstakes and his/her name, street address, city, state, zip code, and phone number ("Verification"). If the potential winner does not respond to the email within ten (10) calendar days confirming this information, Administrator will select an alternate winner. If any potential winner is found to be ineligible or not in compliance with these Official Rules, declines to accept the prize, if Administrator is unable to contact a potential winner, or in the event that the prize confirmation, notification email, or prize (or any part thereof) is returned undeliverable, the prize will be forfeited, and alternate potential winner will be selected. If Administrator has reason to suspect that winner provided a false name, street address, phone number, or other personal contact information, Administrator, in its sole discretion, may require that winner provide, within ten (10) calendar days, additional information to verify that the entry information is legitimate or the prize will be forfeited. If the Administrator wishes to select an alternative potential winner, Administrator will select this alternative potential winner at random from the pool of remaining eligible entries received during the Entry Period. Only one (1) alternate drawing will be held, after which the prize will remain un-awarded. The prize will be fulfilled approximately six (6) weeks after the conclusion of the Entry Period. Administrator's mailing of the prize to the winner's self-provided name and street address shall be deemed fulfillment of the prize.

6. Prizes: Each winner will receive a One Hundred Dollar ($100.00) Visa Gift Card. The approximate retail value ("ARV") of the prize in the Sweepstakes is One Hundred Dollars ($100.00) or a total of One Thousand Dollars ($1,000.00) for all prizes. Prizes are non-transferable and non-assignable, and are not refundable, and must be accepted as awarded. A prize is not redeemable for cash. If a prize is lost, stolen, or misplaced, Amplitude will not replace the prize and is not liable or responsible to you for the lost, stolen, or misplaced Prize. Any applicable taxes, fees or surcharges on the prize are the responsibility of the winner. Visa is not a participant in or a sponsor or co-sponsor of this promotion and is in no way affiliated with Amplitude or ELAP.

7. Odds of Winning: The odds of winning depend upon the number of eligible entries received. The number of entrants who will participate in the Sweepstakes cannot be predicted. Only ten (10) prizes will be awarded for the Sweepstakes.

8. Cancellation of Sweepstakes: Sponsor may cancel, suspend or terminate the Sweepstakes at any time. If the Sweepstakes, or any part of it, is cancelled or discontinued for any reason, Sponsor, in its sole discretion, may elect to hold a random draw from among all the eligible entries received up to the date of discontinuance.

9. RELEASE FROM LIABILITY: RELEASE FROM LIABILITY: BY ENTERING THE SWEEPSTAKES, EACH ENTRANT AGREES TO RELEASE AND HOLD HARMLESS SPONSOR, ADMINISTRATOR, ELAP, VISA, VISA INTERNATIONAL SERVICE ASSOCIATION, AND ITS AND THEIR RESPECTIVE PARENTS, SUBSIDIARIES, AFFILIATES, AND ITS AND THEIR MEMBERS, MANAGERS, SHAREHOLDERS, DIRECTORS, OFFICERS, EMPLOYEES AND AGENTS FROM AND AGAINST ANY AND ALL CLAIMS, DEMANDS, LIABILITY, DAMAGES, AND JUDGMENTS, INCLUDING, WITHOUT LIMITATION, CLAIMS FOR PERSONAL INJURY, DEATH, OR DAMAGE TO, OR LOSS OF, PROPERTY, ARISING OUT OF, RESULTING FROM, OR IN CONNECTION WITH, PARTICIPATION IN THE SWEEPSTAKES AND/OR RECEIPT AND USE OF A PRIZE. VOID WHERE PROHIBITED, AS SOME JURISDICTIONS MAY NOT ALLOW LIMITATIONS OF EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES.

10. Limitation on Liability: Sponsor, Administrator and ELAP are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Sweepstakes; (4) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Sweepstakes or receipt or use or misuse of any prize. If for any reason a person's entry is confirmed to have been erroneously deleted, lost or otherwise destroyed or corrupted, the person's sole remedy is another entry into the Sweepstakes, if the Entry Period has not expired. No more than the stated number of prizes will be awarded.

11. NO WARRANTIES: SPONSOR, ADMINISTRATOR AND ELAP MAKE NO WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT AS REGARDS TO ANY PRIZE OR ANY COMPONENTS OF THE PRIZES. VOID WHERE PROHIBITED, AS SOME JURISDICTIONS MAY NOT ALLOW LIMITATIONS EXCLUSION OF IMPLIED WARRANTIES.

12. Representations: Each person entering the Sweepstakes represents, warrants, and covenants that: (i) his/her submission or entry does not and will not infringe, misappropriate, or otherwise violate the intellectual property, proprietary, and/or privacy rights of any third party or third parties; (ii) he/she has the legal right to disclose and submit its submission or entry to Sponsor; (iii) he/she satisfies all eligibility requirements for eligibility in the Sweepstakes; (iv) he/she will not engage in any fraudulent activity in connection with the Sweepstakes; (v) all personal information submitted by that individual (such as name, street address, city, state, zip code, phone number, etc.) is accurate; and (vi) he/she has and will comply with these Official Rules.

13. Disputes and Governing Law: Disputes and Governing Law: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate Florida State Court located in Palm Beach County, Florida; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys' fees; and (3) under no circumstances will a person be permitted to obtain awards for, and such person hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Florida without giving effect to any choice of law or conflict of law rules (whether of the State of Florida or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Florida.

14. Privacy Rules: Sponsor collects personal information from participants when they enter the Sweepstakes. As applicable, the information collected is subject to the Privacy Policy of Sponsor located at: http://www.amplituderesearch.com/privacypolicy.shtml. Sponsor may be contacted directly by an entrant concerning any request to correct, amend, or delete personal information held by Sponsor. Such a request must be sent in writing, include clear identification of the information to be changed or removed, and mailed to Sponsor with correct postage.

15. Miscellaneous: Participation constitutes an entrant's full and unconditional agreement to these Official Rules. Sponsor's and Administrator's decisions are final and binding in all matters related to the Sweepstakes. Void where prohibited or restricted by law and is subject to all applicable federal, state, and local laws and regulations. All trademarks are property of their respective owners.
